HORSEBACK RIDING/TRAINING RELEASE AND WAIVER OF LIABILITY

 

ASSUMPTION OF RISK AND INDEMNITY AGREEMENT

READ THIS AGREEMENT CAREFULLY BEFORE SIGNING.
BY SIGNING THIS AGREEMENT, YOU (AND/OR YOUR CHILD) ARE WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.

This agreement is entered into by and between Hacienda Santa Maria Inc. (hereinafter referred to as “The Releasees”), including its owners, trainers, employees, agents, volunteers, affiliates, and all persons associated with its equestrian activities, located at 8712 Wellington Rd 50, Erin, Ontario, Canada.

I, [Full Name], and my minor child (if applicable) [Child’s Full Name], residing at [Full Address], in consideration for being permitted to participate in horseback riding, handling, and related activities, acknowledge and agree to the following terms:

  1. ASSUMPTION OF RISK

1.1. I acknowledge that equine activities involve inherent risks, including but not limited to:

      • Horses may buck, stumble, fall, rear, bite, kick, bolt, or make unpredictable movements.
      • Equipment (saddles, bridles, etc.) may fail or break unexpectedly.
      • Riders may fall or be thrown, resulting in serious injury or death.
        1.2. I fully understand and accept that horseback riding is a dangerous activity, and I voluntarily assume all risks associated with equine activities, whether foreseeable or unforeseeable.
  1. WAIVER AND RELEASE OF LIABILITY

2.1. I irrevocably release, discharge, and agree not to sue Hacienda Santa Maria Inc. or its affiliates for any injury, death, or property damage, including but not limited to those caused by:

    • The negligence of The Releasees.
    • Any actions, errors, or omissions by trainers, employees, or staff.
    • The selection, training, or behavior of horses.
  1. INDEMNIFICATION AGREEMENT

3.1. I agree to indemnify and hold harmless The Releasees from any claims, demands, damages, or legal fees arising out of my (or my child’s) participation in equine activities.

3.2. If a lawsuit is filed against The Releasees in violation of this agreement, I agree to pay all legal costs and attorney fees incurred in defending such an action.

  1. HELMET REQUIREMENT AND SAFETY ACKNOWLEDGMENT

4.1. I understand that all riders are required to wear an ASTM/SEI or FEI-certified helmet.
4.2. I acknowledge that wearing a helmet does not guarantee protection from serious injury.

  1. GOVERNING LAW AND SEVERABILITY

5.1. This agreement shall be governed by the laws of the Province of Ontario, Canada.
5.2. If any portion of this agreement is found to be invalid or unenforceable, the remainder shall remain in full force and effect.

  1. MEDICAL AUTHORIZATION

6.1. In the event of an emergency, I authorize Hacienda Santa Maria Inc. to seek medical treatment for myself or my child. I accept full financial responsibility for any medical care provided.

  1. PHOTOGRAPHY RELEASE

7.1. I grant Hacienda Santa Maria Inc. permission to use photographs or videos of me/my child for promotional purposes. No personal details will be shared without further consent.

  1. CANCELLATION AND PAYMENT POLICY

8.1. Cancellations must be made at least 48 hours in advance via text, email, or phone call.
8.2. Late cancellations (within 2 hours of the session) require full payment and cannot be rescheduled.
8.3. No-shows (arriving more than 20 minutes late) will forfeit their session with no refund.
8.4. Monthly session plans must be paid in advance. Late payments may incur a $20 late fee.

  1. FORCE MAJEURE (UNFORESEEABLE CIRCUMSTANCES)

9.1. Hacienda Santa Maria Inc. shall not be liable for any failure or delay in performing its obligations due to events beyond its control, including but not limited to acts of God, natural disasters, government restrictions, pandemics, or other unforeseen circumstances.

  1. EXCLUSION OF WARRANTIES

10.1. The Releasees make no warranties, express or implied, as to the safety, training, suitability, or behavior of any horse provided by Hacienda Santa Maria Inc. The undersigned acknowledges that all horses, regardless of training and past behavior, may act unpredictably at any time.

  1. CONDUCT AND EXPULSION

11.1. Hacienda Santa Maria Inc. reserves the right to refuse service or remove any participant from its premises if their behavior is deemed dangerous, disruptive, or inappropriate, with no refund provided.

  1. WAIVER OF INSURANCE SUBROGATION

12.1. The undersigned waives any rights to subrogation or reimbursement from The Releasees by any insurance provider or other entity that may pay medical costs on behalf of the undersigned.

  1. CONFIDENTIALITY OF PERSONAL DATA

13.1. All personal information collected by Hacienda Santa Maria Inc. shall be used solely for internal purposes and will not be shared with third parties without consent, except as required by law.

ADDITIONAL INFORMATION:

    • Health considerations: Please note any health conditions that must be taken into account if medical care is required.
    • Photography Release: I allow my own/my child’s picture and/or video to be taken and published to the Hacienda Santa Maria Inc Facebook, Instagram page and/or Hacienda Santa Maria Inc website. No names or personal information will be posted without further written or oral consent.
    • Medical Release: I authorize Hacienda Santa Maria Inc and its agents or operators to provide access to medical treatment at the nearest hospital if necessary.
